Eric Houser to Speak at the Mortgage Bankers Association Legal Issues and Regulatory Compliance Conference

Mr. Houser will be speaking at the Mortgage Bankers Association Legal Issues and Regulatory Compliance Conference on May 7, 2017 in Miami. Mr. Houser will be speaking about the FCRA, FDCPA and the TCPA, including bankruptcy and lien priority disputes.

Eric Houser Chairs the Food from the Bar Campaign for Orange County. Mr. Houser is chairing the Food from the Bar inaugural campaign for the Second Harvest Food Bank in Orange County. The Food from Bar OC involves law firms and other legal associations in Orange County volunteering their time, money and food donations at the Second Harvest Food Bank in Orange County. The campaign runs from May 1, 2017 to June 2, 2017. For those interested in the campaign, please contact Mr. Houser.



Q2 2016 - Ninth Circuit Creates Bright-Line Test for Retroactive Application of TILA Amendments

The Ninth Circuit became the first federal appellate court to reject a claim of retroactive application of Truth In Lending Act 2009 amendments. Talaie v. Wells Fargo Bank, NA, No. 13-56314, 2015 WL 8606014, at *2 (9th Cir. Dec. 14, 2015). here.



October 18, 2016 - SURVIVORS BILL OF RIGHTS: CALIFORNIA’S EXPANSION OF FORECLOSURE PREVENTION RIGHTS TO NON-BORROWERS

In September 2016, California’s Governor, Jerry Brown, signed into law SB 1150, which was enacted to provide protections to surviving spouses and other heirs from alleged abuses by mortgage servicers after the death of a borrower.

August 16, 2016 - The Ninth Circuit Strikes a Major Blow to Nevada HOA Purchasers

Lenders and Servicers have been frustrated with Nevada for the last two years for giving HOA's priority status over secured first liens. This has resulted in substantial losses to the mortgage industry and a windfall to speculators and rent skimmers.

June 25, 2015 - The Firm was pleased to host several members of the Massachusetts state legislature at our Boston office.

Among those in attendance was the chairman of the Joint Finance Committee for the Massachusetts Legislature, Rep. Aaron Michlewitz. Houser & Allison, APC was proud to welcome Rep. Michlewitz, along with State Representative Jim Cantwell, for a luncheon event.



March 4, 2015 - Houser & Allison, APC wins Jury trial in Federal Court on New Arizona Claim

The Firm overcame a hostile media and a new expanded claim under Arizona law to prevail in Federal Court.  The jury reached a 8-0 unanimous defense verdict. The case involved fraud allegations and a new claim in Arizona recognized in 2014 by an Arizona Court of Appeals. The plaintiffs’ “negligent performance of an undertaking” claim had not been previously examined by an Arizona jury. The plaintiffs/borrowers argued that that the defendant loan servicer “instructed” them to default, induced them to apply for a HAMP loan mod, and then negligently processed the application. The newness of the claim resulted in a packed courtroom and a number of articles in print and on the nightly news which unfairly depicted the actual evidence of the case. During the trial, the judge granted the Firm’s motion for judgment as a matter of law on the plaintiffs’ punitive damages claim, but let the remaining claims go to the jury. In the end, by convincing the jury to keep an “open mind” and focus on the evidence, the Houser Firm was able to prevail. The Houser Firm proved that the servicer properly handled the account and complied with Arizona law. The trial was handled by Bob Norman (Los Angeles office) and Sol Krotzer (Phoenix office).

April 30, 2014 – Attorneys Participate in Alumni Panel at Boston University


Attorneys Jessica Babine and Chris Cornetta participated as alumni panel members in the Real World Careers event at Boston University’s Center for Career Development. The event gathered an alumni panel to discuss careers in international relations, government and law. April 1, 2014 – Firm Opens Office in Minnesota


The Firm is pleased to announce that it has opened an office in Minnesota. The office is anchored by attorneys, Daniel Sathre and Adam Matheson. Mr. Sathre graduated from the University of Minnesota and obtained his law degree from Notre Dame School of Law. Mr. Matheson graduated from the University of Iowa, Phi Betta Kappa, and obtained his law degree from the University of Minnesota School of Law. Both gentleman clerked for local judges and are Minnesota natives.



December 6, 2013 – Boston Office Hosts Event with Governor of Massachusetts


We are pleased to announce that legislators in Massachusetts chose our Boston office to host an event with the Governor of Massachusetts, Deval Patrick. September 26, 2012 – Houser & Allison, APC Prevails in Class Action Suit

On September 26, 2012, Houser & Allison, APC prevailed on summary judgment in a putative class action in the United States District Court, Central District of California.  Houser & Allison, APC represented clients Deutsche Bank National Trust Company as Trustee, Ocwen Loan Servicing, LLC, and Western Progressive, LLC in this matter which involved claims that Defendants conspired to manipulate the London Interbank Offered Rate (LIBOR) to drive up loan interest rates.  Houser & Allison, APC proved that the Plaintiff’s allegations were purely speculative.

June 23, 2012 – Houser & Allison, APC Participates in Mud Run Benefiting Charity

On June 23, 2012, Houser & Allison, APC sponsored a team to run in the “Summer of Mud” Mud Run in Orange County, CA.  A number of Houser & Allison, APC’s attorneys and staff joined thousands of mud runners through Southern California to participate in the mud run and raise money benefiting the non-profit organization, Blind Start of America.  We look forward to returning next year to continue to support this great organization.

June 11, 2011 - Houser & Allison sponsors Wounded Warriors presented by the 9-11 HelpAmerica Foundation

On June 11, Houser & Allison joined the 9-11 HelpAmerica Foundation in sponsoring its 5th Annual Wounded Warrior Golf Tournament at Brookside Golf Course in Pasadena, California. Attorney Jason Boss joined numerous golfers throughout Southern California to participate in a golf tournament and charity auction, which raised money to assist America’s soldiers wounded in action. We look forward to returning next year to continue to support and thank the brave men and women of our military.

April 11, 2011 - Firm Sponsors Autism Charity Event in Greenville, SC

On April 10-11, Eric Houser and Jason Boss attended a two-day charity event and golf tournament in beautiful Greenville, South Carolina, hosted in part by our client, Wingspan Portfolio Advisors. The charity event benefited Project HOPE, a foundation which leads the way in educating and serving children with autism and their families. Mr. Boss’ team scored a 10 under par at the golf tournament, including a birdie on the hole sponsored by Houser & Allison, APC. We look forward to returning next year as proud sponsors of Project HOPE.

April 11, 2011 - Houser & Allison, APC wins April jury trial

On April 11, 2011, Houser & Allison, APC prevailed in a week long jury trial in San Diego County Superior Court. The matter involved allegations regarding fraud and wrongful foreclosure. Houser and Allison, APC proved that the foreclosure sale complied with California law and that title was duly perfected. The jury deliberated for less than one hour and returned a verdict in favor of the Firm’s client plus awarded $43,284.36 in damages. Lead trial counsel was Charles Tony Piccuta.

March 16, 2011 - FDIC Outside Counsel

The Federal Deposit Insurance Corporation (FDIC) has approved Houser & Allison, APC as Outside Counsel. Houser & Allison is now qualified to act as oversight attorneys for FDIC matters.

March 14, 2011 - Expansion of San Diego Office

On March 14, 2011, Houser & Allison, APC expanded its San Diego Office. The new office is located in suite 200, at 701 Palomar Airport Road, in Carlsbad, California. All of the attorneys in our San Diego office live in the Greater San Diego area and are members of the San Diego Bar Association.

March 10, 2011 - Associate Admitted to Arizona Bar

On March 10, 2011, associate Charles Tony Piccuta, was sworn in as a member of the Arizona State Bar. Mr. Piccuta is the second attorney in the firm admitted to practice in Arizona, joining Robert Norman, Jr.

December 13, 2010 - Houser & Allison Sponsors California Mortgage Bankers Association Event

On December 13, 2010, Houser & Allison, APC cosponsored the Legislative and Regulatory Compliance Conference held by the California Mortgage Bankers Association. Attorneys and CMBA members Eric D. Houser and Robert W. Norman, Jr. attended the event. The conference covered topics including recent state and federal legislation concerning mortgage workout programs, foreclosure notice requirements, deficiency judgments and foreclosure delay referendums. Representatives from the U.S. Department of HUD and Fannie Mae spoke about loan origination requirements and quality control expectations. The attorneys in attendance also participated in a litigation update session which discussed the latest cases and emerging trends in mortgage banking litigation.

November 7, 2010 - Attorney Jill David Completes The New York Marathon!

On November 7, 2010 , New York and California attorney Jill David finished the ING New York City Marathon 2010 in 5 hours 34 minutes. As her first marathon, it was one of the best experiences of her life. The course consisted of all five boroughs, views of the infamous Manhattan Skyline, including the Firm’s NY office and enthusiastic crowds of spectators. Of course, the 26.2 mile run was also a challenge. Jill began training in January 2010 and continued with long runs, hill repeats, and speed training for the next ten months. She recalls marathon day being a lot easier than the actual training, though the tireless efforts of the day should not be undermined. She climbed hills, crossed famous bridges, and navigated through thousands of people to find her way to the finish line. By the time Jill hit the infamous “wall” at Mile 22 she was more than ready to just push through and finish the race. Congratulations, Jill!
